End User License Agreement
1. Agreement to terms
This End User License Agreement (“Agreement”) is between you and the company that employs or engages you (“Customer”) and Landjourney Technologies, operating the Sweet Bennies platform (“Sweet Bennies,” “we,” “us”). By creating an account, signing in, or otherwise using Sweet Bennies (the “Service”), you agree to this Agreement. If you are using the Service on behalf of an employer or organization, you represent that you have authority to accept these terms on its behalf.
Sweet Bennies is made available to you because your employer or another organization (the “Customer”) has a separate agreement with us to administer employee benefit and reimbursement programs. That separate agreement governs the commercial relationship between Sweet Bennies and the Customer; this Agreement governs your use of the Service as an individual end user.
2. What the Service does
Sweet Bennies is a benefits-administration platform that lets employers configure and administer programs such as Lifestyle Spending Accounts (LSA), Health Reimbursement Arrangements (HRA), Individual Coverage HRAs (ICHRA), COBRA administration, expense reimbursements, and incentive programs, and lets employees submit claims, upload receipts, and track reimbursements for those programs.
Sweet Bennies may use automated tools, including AI-assisted receipt reading, to help pre-fill claim fields, flag possible policy issues, or flag potential duplicate or miscategorized submissions. These tools are advisory only. They do not make final coverage, eligibility, or payment decisions — a human reviewer at the Customer or Sweet Bennies makes the final call, and you may always correct or supplement AI-suggested information before submitting a claim.
3. Accounts and access
You access the Service by signing in with your work email, through Google sign-in or your organization’s single sign-on provider. You’re responsible for keeping your credentials secure and for all activity under your account. Notify us promptly at hello@sweetbennies.com if you suspect unauthorized use.
Your access is tied to your relationship with the Customer. If that relationship ends (for example, your employment ends) or the Customer’s subscription ends, your access to the Service may be suspended or terminated.
4. Acceptable use
You agree not to:
- Submit claims, receipts, or information you know to be false, altered, or fraudulent;
- Access or attempt to access another individual’s account, claims, or data without authorization;
- Interfere with, disrupt, reverse-engineer, or attempt to bypass the security of the Service;
- Use the Service to violate any applicable law, including tax, health-benefits, or data-privacy law; or
- Upload malicious code or use automated means to scrape or overload the Service.
5. Health and financial information
Some programs administered through the Service (for example, HRA and ICHRA) involve protected health information (“PHI”) under HIPAA. Where Sweet Bennies processes PHI on behalf of a Customer’s group health plan, it does so as a business associate under a separate Business Associate Agreement with that plan, and handles PHI consistent with HIPAA’s requirements. Where the Service facilitates reimbursement payments (including by ACH transfer), those payments are processed by a licensed third-party payment processor. Sweet Bennies is not a bank and does not itself hold your funds.
6. Third-party services
The Service relies on third-party providers to operate — for example, cloud hosting, identity and single sign-on providers, payment processors, cloud storage for receipts, and AI providers used for receipt reading. Your use of the Service is also subject to the applicable terms of those providers where you interact with them directly (for example, signing in with Google).
7. Intellectual property
Sweet Bennies and its licensors own all right, title, and interest in the Service, including its software, design, and branding. Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose during your relationship with the Customer. You retain ownership of the content and information you submit (such as receipts and claim details), and grant us the rights necessary to process it in order to operate the Service.
8. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Sweet Bennies disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Sweet Bennies does not guarantee that AI-assisted features will accurately read every receipt or correctly apply every plan policy — always review auto-filled information before submitting a claim.
9. Limitation of liability
To the fullest extent permitted by law, Sweet Bennies and its officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability to you for claims arising from this Agreement will not exceed the amount, if any, paid by the Customer to Sweet Bennies for the Service during the twelve months preceding the claim.
10. Term and termination
This Agreement applies for as long as you use the Service. We may suspend or terminate your access if you violate this Agreement, if required by the Customer, or if the Customer’s subscription ends. Sections that by their nature should survive termination (including Sections 7–9) will survive.
11. Changes to this Agreement
We may update this Agreement from time to time. We’ll update the “Last updated” date above when we do, and for material changes we’ll provide additional notice where required by law. Continued use of the Service after a change takes effect constitutes acceptance of the updated Agreement.
12. Governing law
This Agreement is governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles, unless a separate agreement between Sweet Bennies and the Customer specifies otherwise.
